Non-Spoken / English Communication Professional Payment Terms

Please note that the revised rates of pay set out in this document replace any previous rates of pay that may have been sent to you, which you signed and returned at the start of your career with Language Empire.

Please Note: These terms apply to all bookings accepted from the 1st December 2016

At Language Empire we are passionate about delivering high quality BSL and Non-Spoken services to our public sector organisations (mainly NHS and Local Government) throughout the UK.  Language Empire absolutely values all of its professionally qualified and experienced linguists.  This is our main reason for continuing our commitment to provide the best language services, offering a competitive solution in the current economy and competitive environment to our public sector customers in a volatile market.

Our vision, values and beliefs lie in the quality of the services being provided to our public sector customers. As such we invest a large amount of money for the purposes of training and the development of interpreters. However, going forward we would like to invest more in the continuing professional development (CPD) and training of our linguists, at no cost. This will be done in a number of ways and methods such as online e-learning and industry specific certified/recognised training courses.

Please note that the revised rates of pay set out in this document replace any previous rates of pay that may have been sent to you, which you agreed at the start of your career with Language Empire.  This agreement applies to all regions/postcode areas of the UK.   Please sign and return the last page of this agreement to our offices immediately.  Any assignments carried out from 1st December 2016, will now paid at the rates stated in this document.  Customer account managers may not assign any bookings to interpreters that have not signed and returned this agreement.

This agreement has been updated to cover a range of regular issues raised by Interpreters. It is important that you read it and agree to work under the terms and conditions it contains before signing it and returning it to us.   If you do not return it but wish to resume working for us, we are entitled to assume that you do agree to the terms and conditions.    If any issues arise at a later date, it will not be acceptable to excuse yourself on the basis of either that you are not familiar with the contents or that you did not sign because you disagreed with them.

We have amended the band definitions and qualifications relevant to band rates which now apply. Language Empire reserves the right to amend this Rates of Pay Agreement.  All interpreters will be informed of any changes to the Rates of Pay Agreement by email and by post, allowing at least 10 days’ notice.

Services Provided:

Language Empire provides a number of non-Spoken services including;

  • Sign Language Interpreters
  • Interpreters for Deafblind People
  • Lipspeakers
  • Speech to Text Reporters
  • Sign Language Translators
  • Notetakers

PROFESSIONAL REGISTRATION/ MEMBERSHIPS

Communication and Language professionals must hold a trainee/partial registration or membership with a recognised Regulatory/Professional Body. Examples include;

  • British Sign Language (BSL) / English Interpreters (NRCPD or RBSLI Registered)
  • Deafblind interpreters: Visual Frame, Hands-On or Manual (NRCPD Registered)
  • Lipspeakers (NRCPD and / or Association of Lipspeakers Registered)
  • Speech-to-text Reporters (Palantype and SpeedText) (NRCPD, BIVR or AVSTTR Registered)
  • BSL/English translations (NRCPD Registered)

Notetakers (electronic and manual) (NRCPD/ ANP Registered)

WORKING HOURS AND OUT OF HOURS – ENHANCED RATE 50%

Normal Office Working Hours

  • Monday – Friday 07:00 -19:00

Out of office hours will be paid at an enhanced rate of 50% (time and a half) of the original rates. You will see this enhancement shown as a separate line on your payment remittance sheet. When a booking starts in one pay rate time and ends in another, you will be paid enhanced rate for the hours worked in the enhanced time. If more than half the total time worked is in the enhanced rate time, you will be paid for all the hours at enhanced rate.

Out of Office Working Hours

  • Monday – Friday 19:01 -06:59
  • At any time during weekends (Friday 19:31 {Saturday & Sunday} to Monday 07:30)
  • At any time during any public and bank holiday (day and night)

  • Language Empire will pay you for the minimum hours for each assignment booked through us, which you attend.
  • You will be paid for each booking you attend as long as you go to the session with a valid reference number, Job sheet, arrive at the agreed time and the booking takes place.
  • You are required to remain at the booking, until the professional authorises you to leave.
  • If the professional does not attend, you must inform the office before leaving the booking location. You are required to wait a minimum of half the duration you are being paid for i.e. minimum 2 hours, you are required to wait for 1 hour, before leaving the venue.

CANCELLATION BY LANGUAGE EMPIRE

If Language Empire cancels an assignment, you will be paid the following cancellation charges  regardless of the notice period you received when receiving the booking e.g. if we offered you a booking with 3 days’ notice, which gets cancelled  on the day you will receive 100% cancellation payment.

If, however, at the time of cancellation Language Empire is able to offer an alternative assignment of a similar type under comparable conditions and circumstances for all or part of the period of the original assignment, Language Empires liability to the Interpreter in respect of cancellation fees shall be reduced by the amount of the fees payable for the alternative assignment.

ADDITIONAL TIME

  • After the first two hours additional payments will be made in 15 minute increments.
  • If your booking appointment lasts more than 2 hours, any additional time will be paid in 15 minute increments. You will be paid for any additional time, longer than the minimum payment, you work even if it exceeds the booked duration.
  • If the professional requires you to stay longer, and you are able to do so, any additional time will be authorised so please ensure this is facilitated, where possible.’

CONSECUTIVE ASSIGNMENTS & BLOCK BOOKINGS

  • If you carry out consecutive assignments at the same venue for different patients/clients, you will be paid within the same rate or for additional time rather than being paid for two separate assignments at the fixed rate.
  • At times, it may be possible for you to complete two bookings which are adjacent to one another. Where this is possible, Language Empire will endeavour to arrange bookings / appointments allowing you to do so.
  • In other cases, Language Empire may require/assign you to a number of sequential bookings, which require your specific language skills.
  • Language Empire Account Manager will work with you and our clients to meet this need in order to reduce costs to the customer organisation. Payment will be based on the time for which you will be booked and not on individual patient/client basis.

IF YOU CANCEL AN ASSIGNMENT

Language Empire as a result of linguists cancelling, may let down our Customers and Service Users who need the services of a linguist.  You must contact Language Empire in the very first instance you are aware you will not be able to attend an assignment. Language Empire will consider the reason for the cancellation and will take into account genuine unforeseen circumstances. It is at the discretion of the Account Manager to determine if the reason provided is acceptable and where required evidence can be provided.

Where you contact Language Empire to cancel an assignment, which you had originally accepted and the reason provided is determined un-acceptable, the following terms will apply:

  • You may if you wish, find a replacement interpreter for LE. If you are unable to find a replacement then you must contact LE as soon as possible.
  • Where you are not able to find a replacement interpreter, the following cancellation penalties will apply and you required to issue Language Empire with a credit note for the cost of one booking
  • You are required to reimburse Language Empire – regardless of the notice period received when receiving the booking e.g. if we offered you a booking with 5 days’ notice, which you later cancel a 100% charge will apply

IF YOU ARRIVE LATE TO AN ASSIGNMENT

  • If you arrive late to a booking and the customer does not use your services, no payment will be issued.
  • A credit note will be issued to the customer if your reason for arriving late is not acceptable and therefore we will require a credit note from you or the next booking free of charge.
  • We do take into consideration genuine unforeseen circumstances. Providing you have given the company satisfactory evidence to prove your circumstances we will not require a credit note or the next booking free of charge.

IF YOU FAIL TO ATTEND AN ASSIGNMENT (DNA)

  • If you are booked for an assignment and you fail to attend without informing Language Empire a credit note will be issued to the customer.
  • Therefore we will require a credit note from you or the next booking free of charge.

IF A COMPLAINT IS RECEIVED

  • If a complaint is received the interpreter will be subject to the complaints procedure and if necessary be given the opportunity to apologise and undertake training or mentoring for a short while to ensure the same thing doesn’t happen again.
  • If we receive a complaint from the service user or customer, and this is investigated and deemed that you as the interpreter was at fault, Language Empire will not charge the customer for the booking.
  • If we receive a complaint from the service user or customer, and this is investigated and deemed that you as the interpreter was at fault, as a result Language Empire reserves the right not to pay you for the assignment from which the complaint was received, where the standard of the service being provided was deemed unsatisfactory.

Any complaint of a serious nature will be passed onto the NRCPD to further investigate.

JOB SHEETS

It is Language Empire’s intention to pay all interpreters on time and in order to ensure this is done we are now enforcing the following controls as of the 1st December 2016:

  • Your job sheet must be signed by the professional who used your service.
  • Your signed Job Sheet accompanied by your invoice must be submitted by cut-off point (date) as stated on the job sheet.
  • We will not be chasing up job sheets to be returned to us. It is your responsibility to make sure they are submitted.
  • We will NOT accept job sheets after the cut-off point and invoices to the customer organisations (along with the job sheets) will only be processed for the job sheets we have received from interpreters on time. We will issue invoices immediately to ensure prompt payment to interpreters who do submit their job sheets on time.
  • No claims for non-payment of job sheets which were submitted after the cut-off point will be made under this agreement.
  • In a bid to improve this process, we will be sending email confirmations of job sheets received for each booking so that when you submit a job sheet to Language Empire, once it has been processed you will receive an email confirmation of receipt of your job sheet. We will not accept responsibility for job sheets lost via post or emailed to the incorrect department or email address.
  • If you do not receive a receipt of confirmation via email of your job sheet, please resend it.

RETURNING YOUR JOB SHEET

PAYMENT TERMS

  • All payments will be authorised and transferred providing we have a job sheet signed by you and signed by the Professional (service user) from the Customer Organisation.
  • Upon receiving your completed job sheet your payment remittance will be processed with 1-2 days, providing it was received on a working day i.e. Mon-Fri.
  • Payments will be transferred directly into your bank account within 2-3 working days of your payment remittance being issued.
  • It is therefore essential that you have provided Language Empire with your correct bank details or updated bank details if you have moved banks recently.

PAYMENT QUERIES 

  • If payment is not made within expected time frame, or there is a discrepancy in the amount paid, you must this in writing to us via email: payments@empire-groupuk.com.
  • For audit trail purposes all payment queries must be put in writing to us – payment queries will not be deal with over the phone.
  • If the query is of a complex nature, which you are unable to describe in an email, send an email requesting a call, detailing the best time to call you and someone from our experienced team of finance assistants will call you.
  • Our finance team will endeavour to contact you to resolve your query within 7 working days.
  • Sometimes, it can take longer than 7 working days, please be patient, we guarantee that your enquiry will be looked into and resolved.
  • You will either receive a response in writing or via phone.
  • If your query still has not been resolved after a period of 10 working days or you are not happy with the outcome of your query, please email our Linguist Relations Management team on interpreters@empire-groupuk.com with a brief detail of the issue and you will be contacted within 24 hours.
  • Please note Language Empire will not tolerate any form of harassment or verbal abuse towards members of its staff.
  • All our calls are recorded and any such incidents will be immediately investigated and or reported to the NRCPD.

Please note: In order to claim travel and mileage claims for Interpreting sessions all evidence should be attached to the Jobsheets and where possible receipts or public transport details should be provided. We will check and amend all claims accordingly. Every mileage claim must be supported with evidence that it is reasonable. If there are questionable discrepancies, there may result in a delay in payment until this is resolved. If you use public transport, we check average travel times and fares with the public transport provider and pay accordingly.

MILEAGE          

  • £0.40p per mile
  • To paid from the start of the travelling point to the destination, not necessarily the home address.

PUBLIC TRANSPORT

  • Public Transport costs will only be refunded where the return journey is the most economical route taken.
  • 100% of the original fare of public transport will be reimbursed such as bus, train and tube tickets only if original tickets or receipts are provided.

PARKING TICKETS

  • Parking costs as per receipt.

Travel time may be negotiated if you are required and agree to a booking that involves long distance travelling. This will be pre-authorised at the discretion of Language Empire and must be agreed at the point of accepting the booking.

INTERPRETERS FOR DEAFBLIND PEOPLE
